Personal data and privacy policy

 

 When using the website www.noo-family.fr, from a computer or a smartphone (hereinafter the "Service"), NOÖ may collect and process personal data (hereinafter the "Personal Data") about the persons using the Service (hereinafter the "Users").

The purpose of this Personal Data and Privacy Policy (hereinafter the "Policy") is to inform Users of the use that NOÖ makes of their Personal Data, in compliance with applicable French and European legislation, in particular Law No. 78-17 of January 6, 1978 relating to information technology, files and freedoms (hereinafter the "Data Protection Act") and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of Personal Data and on the free movement of such Personal Data, and repealing Directive 95/46/EC (hereinafter the "GDPR") (hereinafter together the "Applicable Regulations").

By accessing and/or using the Service, the User (Customer, Professional, or visitor to the Site) accepts that his Personal Data be collected and processed under the terms and conditions set out below.

The Policy is an integral part of the Terms and Conditions of Service (hereinafter the "TOS") and the Terms and Conditions of Sale (hereinafter the "TOS") and must be read in conjunction with these TOS and TOS.

The Policy may be modified at any time by NOÖ, in particular in order to comply with any legislative, regulatory, jurisprudential, editorial or technical changes.

However, when visiting the site www.noo-family.frother companies are likely to collect personal data concerning the User.

WordPress, the website editor selected to create the Noö platform, is likely to collect data from users, who should refer to the following policy: https://fr.wordpress.org/about/privacy/

MangoPay, provider of the payment solution implemented by NOÖ, may collect data from users, who should refer to the following policy: https://www.mangopay.com/privacy_doc/Privacy_FR.pdf

In order to provide the Service to the Users, NOÖ may need to collect Personal Data about them.

Purposes of the processing 

 

The Personal Data are collected and/or processed when the User uses the Service in order to :

  • Providing the Service, ensuring its proper functioning: NOÖ enables the connection between Clients (Users) and Professionals offering support services dedicated to single-parent families;
  • To improve the Service, in particular to optimize or offer new features to the Service;
  • To facilitate the User's navigation on the Service;
  • To proceed with the registration of Users to the "NOÖ" Service,
  • Proceed to the registration of the Professionals
  • To inform Users of NOÖ's offers and news, unless the User objects, as well as offers and news from NOÖ's partners, if the User has given his/her consent.
  • Manage the User relationship via Customer Service;
  • Manage the relationship with the Professionals
  • Manage billing and payment operations via the MangoPay platform;
  • To adapt and optimize the display of content, in particular advertising, of the Service, and promotional offers, to the parameters or preferences, appetites and centres of interest, proven, assumed or deduced, of the User, which may result from his/her use of the Service, the information he/she has entered or his/her navigation and interactions with the Service;
  • To measure the audience of the Service;
  • Provide sharing tools on social networks when the User has consented to share information;
  • Fighting fraud and non-payment ;
  • Secure the Site, the Application and the Service. 

 

 

Legal basis for processing

 

Under the Data Protection Regulations, in order to use the User's personal data, NOÖ must ensure that it has one or more of the following legal bases:

  • the execution of a contract (for example to process and execute a Support Service or to open and manage a User account), or 
  • the fulfilment of a legal obligation (e.g. keeping invoices for accounting and tax purposes), or 
  • when this is in the legitimate interest of NOÖ, without this being in conflict with the rights and freedoms of the User, or 
  • the User has given his consent (e.g. linking his social network accounts to the Service)

 

 

Recipients of the data

 

The Data collected or processed when the User uses the Service is intended for NOÖ entities, authorised and authorised persons of NOÖ who, by virtue of their functions, need to know it for the purposes of processing, as well as :

- Professionals offering their support services - listed by NOÖ : social workers, lawyers, career management coaches, post-separation coaches, self-confidence coaches, parenting and single parenting coaches, tidying up coaches, budgeting coaches, psychologists, therapists, computer support assistants, homework support coaches, etc.

- The technical service providers chosen by NOÖ, including WordPress, MangoPay, Airtable and Zoom, who may be involved in hosting and storing User Data on their servers, ensuring the security of NOÖ's technical infrastructure, proceeding with the payment of the Services, structuring the collection of data via forms and providing the videoconference service.

- NOÖ's partners, such as marketing partners (commercial canvassing, etc.), may be required to process Data in order to provide the Service and to set up joint communication plans.

- Social networks in the event that the User has expressly consented to the association of his User account with his social network accounts at the time of his registration on the Site.

- Third-party applications accessible from the Site or the Application, in the event that the User has given his/her express consent when using each application.

- Administrative or judicial authorities. NOÖ may be required to communicate information relating to its Users, including Data, to administrative or judicial authorities, in particular in the context of judicial requests.

 

 

Transfer of personal data outside the European Union

Noö does not transfer personal data outside the European Union.

Some professionals may be based outside the European Union, it is their responsibility to respect the regulations in force with regard to Users in the event that they have access to their personal data.

 

 

Duration of storage of personal data

 

NOÖ undertakes not to keep the User's Personal Data beyond the period strictly necessary for the purposes for which they are processed, and in accordance with the Applicable Regulations.

NOÖ undertakes to archive or delete the User's Personal Data as soon as the purpose and/or the duration of their storage expires. In all cases, the maximum periods are those described in the table below.

These maximum periods apply, unless the User requests the deletion or cessation of processing of his/her Personal Data before the expiry of these periods.

Security of personal data

In accordance with the Applicable Regulations, NOÖ treats Personal Data in a secure and confidential manner.

In particular, NOÖ implements all technical and organisational measures to guarantee the security and confidentiality of the Personal Data collected and processed, and in particular to prevent them from being distorted, damaged or communicated to unauthorised third parties, by ensuring a level of security adapted to the risks associated with the processing and the nature of the Personal Data to be protected, taking into account the level of technology and the cost of implementation.

However, NOÖ cannot guarantee the confidentiality or deletion of Personal Data made public by the User in the public parts of the Service.

The Service may include links to external websites or sources. The User acknowledges that the Policy only applies to the use of the Service, and does not in any way cover the information collected and/or processed on external sites or sources, which may be linked to the Service. Consequently, NOÖ cannot be held responsible for the practices of these external sites or sources with regard to the collection and processing of personal data, which are governed, where applicable, by the personal data policies of each of these external sites or sources.

Gandi, as the technical host, is responsible for the security of the Service.

 

 

Online payment and fight against fraud

 

The online payment and the fight against fraud are carried out exclusively by the partner supplier of the online payment solution, MangoPay.

 

 

Rights of the User on his personal data

In case of exercising the right to object, NOÖ will cease processing the Personal Data, except in case of legitimate and compelling reason(s) for the processing, or to ensure the establishment, exercise or defence of its legal rights, in accordance with the Applicable Regulations.

These rights can be exercised with the NOÖ company that collected the personal data in the following way:

 NOÖ will send a reply within 1 month of the exercise of the right. In some cases, due to the complexity of the request or the number of requests, this period may be extended by 2 months.

 

Fate of data after the death of the user :

 The User may formulate directives relating to the conservation, deletion and communication of his personal data after his death in accordance with Article 40-1 of Law 78-17 of 6 January 1978. These directives may be general or specific.

Policy on cookies and other tracking devices

 

When using the Service, information relating to the navigation of the User's terminal may be recorded or accessed in Cookies files installed on the User's terminal, subject to the choices that the User has expressed concerning Cookies and that the User may modify at any time.

 

What is a cookie?

A "Cookie" is a small text, image or software file that is deposited and stored in the User's terminal via the User's Internet browser when the User uses the Service, subject to the User's consent and unless the User objects.

Cookies are very useful and allow the Service to recognize the User, to indicate his passage on such or such page and to bring him an additional service: the improvement of his browsing comfort, the securing of his connection or the adaptation of the content of a page to his interests.

What are the purposes of the Cookies used on the Service?

Only the sender of a Cookie is likely to read or modify the information contained therein. The information concerning the User contained in the Cookies used on the Service may be transmitted to subcontractors for the purpose of providing the Service, or to NOÖ's partners for the purpose of personalising the Service.

The NOÖ service is based on the WordPress platform, which uses functional cookies to remember the choices made by Users or the information they provide. This allows us to adapt the platform to their preferences. For example, authentication cookies are functional cookies used for the duration of a session (or persistent if the User checks the "Remember me" option) to allow the User to authenticate on subsequent visits or to access authorized content on multiple pages.

 

Several types of cookies may be used on the Service.

Browser cookies allow in particular:

  • to adapt the presentation of the Service to the display preferences of the User's terminal (language used, display resolution, operating system used, etc.) when Users visit, depending on the hardware and software for viewing or reading that the terminal has;
  • to memorize information entered on certain forms that the User will have filled in when using the Service in order to avoid having to fill them in again during the next visit;
  • to memorize the user preferences, display settings and readers that Users use in order to facilitate their navigation during their next visit to the Service;

User's choice regarding cookies

All the rights of the User recognized in Article X of the Policy are also applicable to the use of Cookies.

Any settings that the User may make may modify his/her navigation on the Service and his/her conditions of access to certain services requiring the use of Cookies. NOÖ shall not be held responsible for the consequences of a less efficient functioning of the Service due to the impossibility of installing or reading Cookies necessary for its proper functioning, once the User has rejected or deleted them.

Users may configure their browser software so that Cookies are saved on their terminal or, on the contrary, rejected, either systematically or according to their sender. Users may also configure their browser software so that acceptance or rejection of Cookies is offered to them from time to time, before a Cookie is likely to be recorded on their terminal.

Please note: exercising the right to object will not prevent the display of advertisements. Only the advertisements using the Service's personalization services will cease. In other words, the User will no longer be exposed to advertisements adapted to his or her centres of interest via the use of Cookies on the Service but will continue to be displayed advertisements whose content will not necessarily be in line with his or her centres of interest.
